1. DEFINITIONS
1.1. “Company” refers to Mvamva Logistics (Pty) Ltd, registered in South Africa.
1.2. “Customer” refers to any person or entity using Mvamva Logistics’ services.
1.3. “Shipment” refers to any parcel, document, or freight item tendered for carriage.
1.4. “Waybill” refers to the document accompanying the shipment, outlining key details, terms, and conditions.
2. ACCEPTANCE OF TERMS
2.1. By tendering a shipment to Mvamva Logistics, the Customer agrees to these Terms & Conditions. 2.2. No employee, agent, or representative of the Company has the authority to alter these terms unless agreed to in writing by authorized Company personnel.
3. SERVICE SCOPE & LIMITATIONS
3.1. Mvamva Logistics provides courier, freight, cross-border, air, and sea shipping services.
3.2. The Company reserves the right to refuse or return shipments at its discretion, including but not limited to:
- Prohibited or hazardous materials under South African laws.
- Items improperly packaged or labeled.
3.3. Delivery timelines are estimates and not guaranteed unless expressly agreed upon. Delays caused by customs, weather, strikes, or force majeure events are beyond our control.
4. LIABILITY & INSURANCE
4.1. Shipments are insured under Mvamva Logistics’ standard cargo insurance. Customers may request additional insurance coverage at an extra cost.
4.2. The Company’s liability is limited to the insured value of the shipment or the declared value, whichever is lower, subject to the following conditions:
- Any claims for loss or damage must be made in writing within 7 days of delivery.
- Proof of value and evidence of damage must accompany the claim.
4.3. The Company is not liable for indirect or consequential losses, including but not limited to lost profits, business disruptions, or missed deadlines due to delays.
5. PACKAGING & CUSTOMER RESPONSIBILITIES
5.1. The Customer is responsible for ensuring that shipments are properly packed, labeled, and secured for transit.
5.2. Fragile or high-value items must be marked accordingly.
5.3. The Company is not responsible for damages arising from inadequate packaging.
6. PROHIBITED ITEMS
6.1. The following items are strictly prohibited from shipment:
- Explosives, firearms, ammunition, and hazardous materials. Narcotics, illegal substances, and counterfeit goods.
- Perishable goods without proper temperature control.
- Any other items restricted under South African laws.
7. CUSTOMS CLEARANCE & REGULATORY COMPLIANCE
7.1. For international shipments, the Customer is responsible for providing accurate documentation for customs clearance.
7.2. Mvamva Logistics facilitates customs clearance but is not liable for duties, taxes, or customs delays.
8. DELIVERY & RECEIPT
8.1. Shipments will be delivered to the address provided by the Customer. The recipient’s signature serves as proof of delivery.
8.2. If delivery is unsuccessful after two attempts, additional charges may apply for re-delivery or storage.
9. PAYMENT TERMS
9.1. All shipments must be prepaid unless the Customer has an approved credit account with Mvamva Logistics.
9.2. Late payments will incur interest at a rate of 2% per month on overdue balances.
10. DISPUTE RESOLUTION
10.1. Any disputes arising under these terms will be governed by South African law and resolved in the appropriate courts of South Africa.
11. AMENDMENTS
11.1. Mvamva Logistics reserves the right to amend these Terms & Conditions at any time. Customers will be notified of significant changes.
